By accessing, browsing, or purchasing from Fitness Canada™ (“we”, “us”, “our”), you agree to be legally bound by these Terms of Service (“Terms”).

Fitness Canada™ is committed to providing accurate product information, transparent pricing, and reliable order fulfillment. We aim to ensure that customers clearly understand product availability, shipping timelines, and applicable policies before completing a purchase.

If you do not agree with any part of these Terms, you must not use this website. Continued use constitutes acceptance of any updated Terms.

1. Sales Territory
  • Retail sales are available exclusively within Canada
  • We do not ship retail orders to the United States
  • FOB export orders may be available upon written request
2. Eligibility
  • You are legally capable of entering a binding contract
  • All information provided is accurate
  • You are authorized to use the payment method
3. Orders & Pricing
  • All prices are in CAD unless stated otherwise
  • Pricing may change without notice
  • Orders may be adjusted or cancelled in rare cases of system errors, pricing issues, or inventory discrepancies

Orders are considered accepted once payment is successfully processed and a confirmation is issued. In exceptional cases, customers will be notified promptly and offered a resolution, including order adjustment or full refund.

Fitness Canada™ reserves the right to refuse or cancel orders in cases of fraud, policy violations, or system errors.

4. Payment Terms
  • We accept major credit cards and approved financing providers
  • Alternative payment methods require prior written approval
  • Full payment authorization is required at checkout

Payment confirmation indicates that your order has been received and is being processed in accordance with product availability and fulfillment timelines.

5. Order Cancellation

Orders may be cancelled prior to shipment. Once shipped, orders are subject to the Refund & Return Policy.

If an order is cancelled prior to shipment, a full refund will be issued. Fitness Canada™ will communicate clearly with customers regarding any order changes.

6. Shipping & Delivery

Shipping timelines are provided as estimates based on current logistics conditions. While delays may occasionally occur due to external factors, Fitness Canada™ works to fulfill all orders within the stated timeframes or provide timely updates.

Risk of loss remains with Fitness Canada™ until delivery is completed in accordance with our Shipping Policy.

Customers are responsible for ensuring adequate delivery access and site conditions.

7. Inventory Availability

Product availability is updated regularly. In the event of discrepancies, customers will be notified promptly and offered the following options:

  • Replacement with a similar product
  • Backorder with updated delivery timelines
  • Full refund
8. Product Use & Safety Disclaimer

All equipment involves inherent risk. Use must follow manufacturer guidelines and safety instructions.

  • Improper use
  • Overloading
  • Unauthorized modification
  • Failure to follow instructions

Fitness Canada™ is not responsible for injuries resulting from misuse or failure to follow proper guidelines.

9. Installation Responsibility
  • Improper installation
  • Floor damage
  • Structural issues
  • Incorrect anchoring

Improper installation may void warranty coverage.

10. Limitation of Liability

To the maximum extent permitted by Canadian law, liability is limited to the purchase amount of the product.

11. Indemnification

You agree to indemnify and hold harmless Fitness Canada™ from claims arising from misuse, violation of Terms, or negligent installation.

12. Fraud & Chargebacks

Fraudulent transactions may be reported to authorities. Invalid chargebacks may result in recovery of associated costs.

13. Intellectual Property

All branding and content are the property of Fitness Canada™ and may not be used without permission.

14. User Content

Submitted content grants us a non-exclusive license for use. We reserve the right to remove inappropriate content.

15. Force Majeure

We are not liable for delays caused by events beyond our control, including supply chain disruptions or external factors.

16. Governing Law

These Terms are governed by the laws of Alberta, Canada.

17. Dispute Resolution

We encourage customers to contact us directly to resolve any concerns. Disputes will be handled in accordance with applicable Canadian laws.

18. Service Refusal

We may refuse service in cases of fraud, abuse, or violation of these Terms.

19. Amendments

Terms may be updated at any time. Continued use constitutes acceptance.

20. Severability

If any provision is invalid, remaining provisions remain enforceable.

21. Entire Agreement

These Terms, together with all referenced policies, constitute the entire agreement between you and Fitness Canada™.
